Amid Jury Win, 5-Hour Energy Faces Unfair Pricing Claims

Law360 (July 16, 2020, 8:05 PM EDT) — Nine months after a jury rejected their bid for monetary damages, seven family-owned wholesalers are gunning for an injunction in California federal court to stop the maker of 5-Hour Energy “shots” from offering favorable pricing to warehouse club Costco for the same product. 

The wholesalers — U.S. Wholesale Outlet & Distribution Inc., Trepco Imports & Distribution Ltd., Eashou Inc., Sanoor Inc., YnY International Inc., California Wholesale and L.A. International Corp. — urged U.S. District Judge Consuelo B. Marshall on Wednesday to issue an injunctive relief, saying that 5-Hour Energy manufacturer Living Essentials LLC is still offering the same “discriminatory advertising and rebate promotions” to Costco…
