Woodworkers Win Class Status of Claims Over Factory Closure

Wood-Mode Inc. must face certified class claims by cabinetry factory workers alleging it didn’t given them sufficient notice before closing their factory, the Middle District of Pennsylvania held Dec. 12.

The workers’ claims under the Worker Adjustment and Retraining Notification Act are suitable for class adjudication because all 900 workers were terminated as part of a mass layoff, the court said.

“This class is sufficiently cohesive that issues common to the class predominate over individual issues,” it said.

But it declined to exercise supplemental jurisdiction over the workers’ state law claims concerning their entitlement to payment for vacation accrued before…
