Henry Schein Price-Fixing Suit Shouldn’t Return to SCOTUS: Rival

Dental supplies wholesaler Archer and White Sales Inc. urged the U.S. Supreme Court not to consider—for the second time—whether industry leader Henry Schein Inc. can force arbitration of its price-fixing lawsuit.

“This case has dragged on for nearly eight years, with the parties twice on the courthouse steps, ready to try their case and resolve their dispute,” Archer says in a brief filed Monday, assailing Henry Schein’s “ever-changing legal theory.”
