Burlington Coat Factory Sued By Joliet Woman

JOLIET, IL — The Burlington Coat Factory at 1300 North Larkin Ave. faces a negligence lawsuit filed by a 67-year-old Joliet woman who claims that a dangerous hazard inside the store caused her to trip and fall to the ground Dec. 10, leaving her injured.

Joliet resident Judith Hemme is being represented Chicago attorney Michael Mead who works at the personal injury law firm of Faklis, Tallis and Mead on East Wacker Drive.

According to his client’s version of events, Hemme was an invitee into the Joliet store and “while in the aforementioned store, tripped and fell due to a metal post protruding into the aisle traversed by customers.”

According to Mead, “Burlington Coat Factory of Illinois, well-knowing their duty in this regard, carelessly and negligently created a dangerous condition by placing a merchandise display with a protruding metal post on the premises in an area traversed by customers.”

The plaintiff’s Will County lawsuit cites five instances of negligence om the part of the Joliet retail outlet such as having “failed to warn customers on the premises, including the plaintiff, of a dangerous condition.”

Hemme’s lawyers have asked a Will County jury and judge to award their client a judgment in excess of $50,000 because she has become liable for “large sums of money for hospital care and attention.

“Judith Hemme suffered personal injuries, has lost and will lose in the future financial gains which she otherwise would have made and acquired,” her lawyers argue.

The next court hearing on the case is set for April 20.
