Texas Supreme Court Upholds Eminent Domain For High-Speed Rail

State law gives modern interurban high-speed electric railways eminent domain power, the Texas Supreme Court said Friday in a 5-3 ruling in favor of two companies that want to build a line between Dallas and Houston.

James Miles sued Texas Central Railroad & Infrastructure Inc. and Integrated Texas Logistics Inc. seeking declaratory judgment that the companies didn’t have eminent domain authority. Texas Central and Integrated Texas are working on a project that aims to connect two major cities via a bullet train rail. Miles’ 600 acre property in Leon County is located along the proposed route.
