The EPA can proceed with its designation of the eastern Long Island Sound as an open-water dredge disposal site, after the Second Circuit on Friday upheld a lower court’s ruling that the site was supported by substantial evidence and the agency followed proper procedures.
New York argued the Environmental Protection Agency violated the Marine Protection, Research, and Sanctuaries Act and the Coastal Zone Management Act when it approved the site designation in 2016. The site will hold an estimated 20 million cubic yards of dredged material.
